We greet all Marxists around the world, because today we celebrate together the 206th birthday of Karl Marx, the birthday of the founder of Marxism.

It is the birthday of one of the greatest revolutionaries in human history.

Karl Marx put all his revolutionary thought and selfless revolutionary deeds at the service of the liberation of the international working class.

Karl Marx was the founder of scientific communism, created the world outlook of the proletariat and became the great leader and teacher of the world proletariat.

On the occasion of the 206th anniversary of his birth, we would like to take a look at

ABOUT JURISTIC QUESTIONS

As far as the juristic question of legality is concerned, we put forward the following Stalinist-Hoxhaist definition:

Stalinism-Hoxhaism, on the juristic question of legality, is the juristic theory and tactics of the struggle for world proletarian legality in general, the juristic theory and tactics of the struggle for legality under the dictatorship of the world proletariat in particular, and finally the juristic theory and tactics of the struggle for the transition to the abolition of all legal norms under world communism. Laws, states and classes, however, will not die out in world communism, neither by themselves nor beforehand. This requires not only a far long period of time in world communism, but also a persistent and patient struggle of the entire world society that never lets up.

Marx and Engels teach that law and legality always have a class character.

For Marx and Engels, law in a class society is always based on the inequality between the exploiters and the exploited.

The ruling class, which has material power, also exercises legal power. For this purpose, the bourgeoisie has its own advocates - as the "Manifesto of the Communist Party" correctly states:

"The bourgeoisie has (...) transformed jurists (...) into its paid wage labourers."

Marx and Engels fought against the idealist views by applying the method of historical materialism. According to this, law is part of the superstructure of class society, which reflects the economic basis of class society. Legal relations are determined by economic relations (basis/superstructure). The subjective factors are subordinate to the objective factors: from the point of view of dialectical materialism, the legal factor can be reversed from an obstacle (in capitalist society) to a driving force (in socialist society) (see quotation of Stalin). With the victory of the world socialist revolution, legal relations thus develop into a powerful lever for the construction of world socialism.

The dictatorship of the proletariat cannot function without the existence of legal norms, just as legal norms cannot be put into practice without the proletarian state and its coercive organs.

World socialist legality is an important principle of the world socialist state, the dictatorship of the world proletariat. In this we differ from the anarchists, for example.

The elaboration and perfection of world socialist legality does not take place without the active participation of the working class, not without the active participation of all labourers. Therein lies the guarantee that the masses of world socialist society, who have made the laws themselves, will observe them voluntarily and be conscious fighters to defend them.

Fighting for the righjts of the world proletariat, fighting for World socialist legality - is a great school of world communism.

While bourgeois law is an instrument of the maintenance of the capitalist world order, world socialist law serves as an instrument of the dictatorship of the world proletariat, especially as an instrument of the struggle against the restoration of world capitalism.

As Marx and Engels taught, the state and its legal arm are not "above the classes", as the representatives of the bourgeois doctrine of the state claim. The various opportunists also claim that bourgeois legality now serves the workers as well as the bourgeoisie. That is nonsense. The fact that we communists are obliged to utilise bourgeois law in the interests of communism is not synonymous with the illusion that the revisionists are fuelling, namely that it would be possible to achieve socialism "peacefully", so to speak, by relying on bourgeois laws [Rudi Dutschke: "The long march of the revolution through the bourgeois state authorities"]. And it was also the revisionists who, where the working class was already in power, replaced the socialist laws with bourgeois laws in order to restore capitalism. Of course, this was always done under the guise of "in the service of socialism".

Karl Marx and the Paris Commune taught us quite clearly that the proletariat cannot simply take over the state machinery of the bourgeoisie and its laws, but must smash it in order to build its own laws, its own socialist state machinery on its ruins.

Between antagonistic classes there can never be equal law and justice for all classes together. The ruling law is the law of the ruling class. For the ruling class, bourgeois law is nothing but the right to exploit, the legal basis for profiteering.

Bourgeois law regards the struggle for the rights of the exploited and oppressed classes as "unlawful", while socialist law - vice vetrsa - declares the exploitative order of capitalism to be unlawful.

In the struggle against legal relations under feudalism, the struggle of the bourgeoisie for the enforcement of bourgeois law had a progressive character (liberty, fraternity, equality). As soon as the bourgeoisie came to power, however, it created the laws of the capitalist exploitative order, which it no longer had to defend against feudalism, but against the exploited working class.

Friedrich Engels writes in "Anti-Dühring":

"The bourgeois demands for equality are accompanied by proletarian demands for equality. From the moment that the bourgeois demand for the abolition of class prerogatives is made, the proletarian demand for the abolition of the classes themselves appears alongside it.

The real content of the proletarian demand for equality is the demand for the abolition of classes." (German edition, MEW, Volume 20, page 99).

With the capitalist crises and wars the class struggle of the proletariat intensifies. The bourgeoisie is all the more forced to resort not only to legal means of ever more stringent legal laws, but at the same time also to illegal means and then from that to legal means of fascist terror.

It is an inevitable law of the bourgeoisie that bourgeois law is finally directed against itself. It is unavoidable for the bourgeoisie to break through the self-created bourgeois legal order ("rule of law") itself and throw it overboard.

The conceptions of law in today's age of globalisation are only the globalised conceptions of law of the world imperialists.

The imperialist legal order is a monopolised, parasitic, rotting and dying legal order.

In conclusion, we quote Karl Marx from "On the Critique of Hegel's Philosophy of Right", which he wrote at a young age (1844). This quote has lost none of its significance for us Stalinist-Hoxhaists to this day:

"As philosophy finds its material weapons in the proletariat, so the proletariat finds its spiritual weapons in philosophy...to accomplish its emancipation." (On the Critique of Hegel's Philosophy of Right. Introduction. MW 1, P. 391, 1844)

Today the Comintern (SH) is the only true defender of Karl Marx and all other 4 Classics. We emphasize again, and we will continue to stress, namely that it is impossible even to defend a single Classic, without defending simultaneously all the other four Classics.

Guided by the invincible teachings of the 5 Classics of Marxism-Leninism we are marching resolutely towards world socialist revolution, towards the dictatorship of the world proletariat towards world socialism and world communism.

We swear to fulfill the great legacy that Karl Marx has left to us.
